Terms of service

These terms are an agreement between you and Sendmint ("we", "us" or "our").Sendmint is operated by Nadaf Traders, India. They apply when you sign up for or use Sendmint.

Please read them carefully. By creating an account or using Sendmint, you agree to these terms. If you do not agree, do not use Sendmint.

1. The service

Sendmint is WhatsApp marketing software for small businesses. It lets you connect your WhatsApp number through Meta, import contacts, create message templates, send broadcast campaigns, reply to customers from a shared team inbox and set up auto-replies.

Sendmint is a Meta Tech Provider and uses the official WhatsApp Business Platform (Cloud API). When you use WhatsApp through Sendmint, Meta's own terms and policies also apply to you, including:

  • the WhatsApp Business Terms of Service;
  • the WhatsApp Business Messaging Policy; and
  • the WhatsApp Commerce Policy.

If these terms and Meta's terms conflict on how you use WhatsApp, Meta's terms apply.

2. Your account

  • You must be at least 18 years old and authorised to act for the business you sign up for.
  • The information you give us must be accurate, and you must keep it up to date.
  • You are responsible for everything done in your account, including by the team members you invite. Give each person only the role they need.
  • Keep your password safe and do not share it. Tell us straight away at support@sendmint.in if you think someone has accessed your account without permission.

Free trial

New accounts get a 14-day free trial. No credit card is needed. The trial ends after 14 days unless you choose a paid plan. We will not charge you automatically when the trial ends.

3. Acceptable use

When you use Sendmint, you must:

  • follow the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy;
  • message only contacts who have opted in to receive messages from your business;
  • honour opt-outs promptly, such as when a contact replies "STOP";
  • comply with Indian laws, including the Digital Personal Data Protection Act, 2023 and TRAI rules where they apply.

You must not:

  • send spam or unsolicited messages;
  • send misleading, fraudulent, offensive or illegal content;
  • promote or sell goods or services that WhatsApp or Indian law prohibits;
  • harass, threaten or abuse anyone;
  • scrape, copy, resell or sublicense the service;
  • try to break or test our security, overload our systems, or access another business's data or account.

4. Meta charges

Meta charges for WhatsApp messages. Meta bills these charges directly to the payment method you add in your Meta account. They are separate from your Sendmint plan.

  • Sendmint shows an estimated Meta cost before you send a campaign. This is only an estimate; Meta's final bill applies.
  • Meta adds 18% GST to its message charges.
  • Sendmint adds no markup on Meta's charges.
  • Meta sets and may change its own prices. Sendmint is not responsible for Meta's prices or bills.

5. Plans and payment

Sendmint offers these monthly plans:

  • Starter: ₹499 / month
  • Growth: ₹999 / month
  • Pro: ₹1,999 / month

How billing works:

  • Sendmint is not GST registered yet, so plan prices have no GST. Meta adds GST to its own message charges (section 4).
  • Plans are billed monthly in advance through Razorpay.
  • Your plan renews automatically every month until you cancel.
  • We may change plan prices. We will tell you at least 30 days before a new price applies to your account.

6. Cancellation and refunds

  • You can cancel at any time from Settings in the app, or by emailing support@sendmint.in.
  • When you cancel, you keep access until the end of the month you have paid for. You will not be charged again.
  • If you ask within 7 days of your first payment, we refund that payment in full.
  • We do not give refunds for later payments or partial months, except where the law requires it, or if we end the service for you without cause. In that case, we refund the unused part of your current month on a pro-rata basis.
  • If we charge you by mistake, we refund the wrongly charged amount within 7 working days.
  • Meta's message charges are billed by Meta, so Sendmint cannot refund them.

7. Suspension and termination

We may suspend or close your account if:

  • you do not pay for your plan;
  • you break these terms or Meta's policies;
  • your use puts the quality rating of your WhatsApp number, or the numbers of other businesses, at risk;
  • we receive a valid legal request; or
  • your account is a security threat to Sendmint or other users.

Where possible, we will give you notice and a chance to fix the problem first. Meta may also limit or block your WhatsApp number on its own, and we cannot control or reverse Meta's decisions.

You can close your account at any time. Before your account is closed, you can export your data. See our data deletion instructions.

8. Your content and data

You own your content and data, including your contacts, templates, campaigns and messages. You give us permission to store and process it only as needed to run the service for you.

You are responsible for your content and for having the right to upload and message your contacts. Our Privacy policy explains how we handle personal data.

9. Intellectual property

Sendmint, including its software, design, logo and name, belongs to us. We give you a limited, non-exclusive, non-transferable right to use Sendmint for your business while your account is active. These terms do not give you any other rights in Sendmint.

If you send us feedback or suggestions, we may use them to improve Sendmint without any obligation to you.

10. Availability and changes to the service

We work to keep Sendmint running smoothly, but we cannot promise it will always be available or free of errors. We may need to pause it for maintenance or updates.

Sendmint depends on Meta's WhatsApp Business Platform. Meta outages, messaging limits, template rejections and other Meta decisions are outside our control.

We may add, change or remove features. If we remove an important feature, we will tell you in advance.

11. Disclaimers

Sendmint is provided "as is" and "as available". To the extent the law allows, we do not give any promises or warranties beyond those in these terms. We do not promise any particular business results, such as sales, replies or delivery rates.

12. Limitation of liability

  • We are not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data or harm to reputation.
  • Our total liability for any claim related to Sendmint is limited to the fees you paid Sendmint in the 3 months before the claim.
  • Nothing in these terms limits any liability that cannot be limited by law.

13. Indemnity

You agree to compensate and protect Sendmint against claims, losses and costs (including reasonable legal fees) that arise from your content, or from your breach of these terms, Meta's policies or the law.

14. Governing law and courts

These terms are governed by the laws of India. The courts at Kolhapur, Maharashtra have exclusive jurisdiction over any dispute about these terms or Sendmint.

15. Changes to these terms

We may update these terms from time to time. When we do, we will post the new version on this page with a new "Last updated" date. For significant changes, we will tell account owners by email or in the app at least 15 days before the changes take effect. If you keep using Sendmint after that, you accept the new terms.
